These Terms and Conditions Agreement govern the use of the smart luggage locker service provided by Lock it Tirana, located at Mine Peza Street. By using our Service, you agree to the following terms. Please read them carefully before using the Service.
Service Overview
The Service allows customers to securely store personal belongings in lockers by selecting a locker size and rental duration via our mobile app.
The Service is accessed by scanning a QR code, which directs users to our app where bookings can be made and you will be directed to Stripe payment platform.
All users of the Service must agree to and comply with these Terms.
Eligibility to Use the Service
You must be at least 18 years old to register and use our Service. Minors are allowed to use the Service only under the supervision and responsibility of an adult.
You agree to provide accurate and complete information during the registration process and to maintain the confidentiality of your account login details.
Booking and Locker Usage
Booking Process: After scanning the QR code, you will be directed to the app where you can choose the size of the locker and rental time. Payments are processed through Stripe.
Rental Period: The rental duration starts from the moment your payment is confirmed. It is your responsibility to collect your belongings before the rental period expires.
Overstay: If you do not remove your belongings from the locker by the end of the rental period, we may charge you additional fees. After 14 days we reserve the right to remove and dispose of any belongings left in the locker, in accordance with applicable laws.
Permitted Items: Lockers may be used only for personal items. You are prohibited from storing any illegal, dangerous, or hazardous materials (e.g., explosives, flammable materials, weapons, drugs, or stolen goods). We reserve the right to inspect locker contents if we have reasonable grounds to suspect a violation of this policy.
Fees and Payments
Payment Platform: All payments are processed securely via Stripe. By using the Service, you agree to abide by Stripe’s terms and conditions, as well as any applicable fees associated with their platform.
Fees: Fees for the rental of lockers are displayed before confirming the booking. All prices are inclusive of VAT and other applicable taxes, as required by Albanian law.
Refunds and Cancellations: Once a booking is confirmed and payment has been processed, no refunds or cancellations will be permitted unless required by law. However, you may extend your rental period before the expiration through the app, subject to availability and additional charges.
User Responsibilities
Proper Use: You agree to use the locker in a responsible manner, adhering to the rules set forth in these Terms. We are not responsible for any loss, damage, or liability resulting from your misuse of the Service.
Security: While we take steps to ensure the security of our lockers, we are not responsible for any theft, loss, or damage to your belongings unless caused by our negligence.
Prohibited Conduct: You may not interfere with the operation of our lockers or use them for unlawful purposes. Violations may result in immediate suspension or termination of your account and may be reported to the appropriate authorities.
Limitation of Liability
Service Availability: We aim to ensure that the Service is available at all times but do not guarantee uninterrupted or error-free operation. You acknowledge that the Service may be occasionally unavailable due to maintenance, upgrades, or technical issues.
Loss of Belongings: Our liability for loss, damage, or theft of items stored in the lockers is limited to cases where such loss was due to our gross negligence or misconduct. In all other cases, we assume no liability beyond the amount paid for the locker rental.
Force Majeure: We are not liable for any delay or failure to perform our obligations under these Terms due to causes beyond our control (e.g., natural disasters, strikes, internet failures, or government actions).
Data Protection and Privacy
Collection of Data: We collect personal data, such as your name, email, and payment details, necessary for providing the Service. Your data will be handled in accordance with Albanian data protection laws, including the Law No. 9887 on the Protection of Personal Data and the EU General Data Protection Regulation (GDPR).
Use of Data: Your personal data will be used solely for processing bookings, payments, and improving the Service. We do not share your information with third parties, except for payment processors (e.g., Stripe) and as required by law.
Data Security: We employ appropriate security measures to protect your personal information from unauthorized access. However, we cannot guarantee absolute security due to the nature of the internet.
Termination of Service
Voluntary Termination: You may choose to stop using the Service at any time by ceasing to use our app or website.
Suspension or Termination by Us: We reserve the right to suspend or terminate your access to the Service if you breach these Terms or misuse our lockers.
Consequences of Termination: Upon termination of the Service, you must remove your belongings from the locker. Any items left behind will be subject to our storage and disposal policies.
Dispute Resolution
Governing Law: These Terms are governed by and interpreted in accordance with the laws of Albania.
Jurisdiction: Any disputes arising out of or related to the Service will be resolved exclusively in the courts of Tirana, Albania.
Arbitration: In case of disputes, we encourage resolution through informal negotiation. If a resolution cannot be reached, both parties may agree to arbitration as an alternative to litigation.
Changes to the Terms
We reserve the right to amend these Terms at any time. Changes will be posted on our app or website and will take effect immediately upon publication. It is your responsibility to review these Terms periodically. Your continued use of the Service constitutes your acceptance of any updated Terms.
